Iraqi Nationality by Descent (Father)
Under Iraqi Nationality Law No. 26 of 2006, a person born to an Iraqi father is an Iraqi national by descent — regardless of where they were born, and regardless of any other nationality they hold. This is the most important route for members of the Iraqi diaspora, as it means that children and grandchildren of Iraqi fathers who were born and raised abroad are Iraqi nationals, even if they have never been to Iraq and hold no Iraqi documentation.
Confirming and documenting this status — obtaining a nationality certificate, civil ID, and passport — requires navigating the Iraqi civil registration system, which often requires tracing and obtaining records going back to the original Iraqi family registration (سجل النفوس).

Nationality through an Iraqi Mother
The 2006 law introduced a significant change from its predecessor: it allows persons born to an Iraqi mother (even where the father is non-Iraqi or unknown) to apply for Iraqi nationality. This was a meaningful reform that opened a route to nationality for a significant number of people previously excluded under the older framework.
However, the route through an Iraqi mother involves a formal application process rather than automatic recognition — unlike the route through an Iraqi father, which is a matter of confirming an existing status. The application is submitted to the relevant Iraqi authority, and the applicant must establish their mother’s Iraqi nationality and their own birth documentation to the authority’s satisfaction.

Restoration of Nationality Previously Withdrawn
A specific and historically significant provision of the 2006 law concerns the restoration of Iraqi nationality for individuals whose nationality was withdrawn under previous governments — particularly individuals who were stripped of nationality during the Baathist era on political, ethnic, or religious grounds, or who lost nationality as a consequence of political persecution.
The law provides a mechanism for restoration of nationality and for the registration of descendants of those whose nationality was wrongfully withdrawn. These cases are often complex and require engagement with specific Iraqi government bodies and, in some cases, Iraqi courts. Situations That Complicate Nationality Cases — and How We Handle Them
Straightforward nationality cases are the exception rather than the rule for diaspora members who have been outside Iraq for decades. These are the complications we most frequently encounter and resolve.
Missing or Incomplete Iraqi Civil Records
Many members of the Iraqi diaspora left Iraq decades ago under difficult circumstances. Civil records may have been lost, destroyed, or never completed for births that occurred abroad. In these situations, we trace whatever records remain in the Iraqi civil registry system and, where records cannot be located, pursue alternative routes — including court proceedings to establish civil status legally — to obtain the documentation needed for the nationality application.
Deceased Parents Without Documentation
Where the Iraqi parent through whom nationality is claimed is deceased, their Iraqi civil records must be traced and obtained without the parent’s cooperation. This requires access to the original Iraqi civil registration records — which we obtain directly from the relevant Iraqi authorities — and in some cases obtaining a death certificate that was never formally registered. We handle these cases routinely, including situations where the parent died outside Iraq and their death was never registered in the Iraqi system.
Dual Nationality Concerns
Iraq formally recognises dual nationality under the 2006 law, representing a significant change from the previous position. Iraqis who acquired foreign nationality and feared this had extinguished their Iraqi nationality can in principle confirm and re-document their Iraqi status. However, the practical interaction between Iraqi nationality law and the laws of other countries requires careful navigation — we assess each dual nationality situation individually and advise on the implications before any steps are taken.
Births Outside Marriage or Paternity Questions
Cases involving births outside of formal marriage, or where paternity is unclear or contested, involve specific legal and procedural considerations under both Iraqi nationality law and Iraqi personal status law. These cases require careful handling — both in terms of the documentary evidence required and in terms of the legal approach taken — and we manage them with full discretion and appropriate sensitivity.
Nationality Withdrawn Under Previous Regimes
Iraqis whose nationality was withdrawn — particularly during the Baathist era, and particularly affecting Kurdish, Shia, and Jewish Iraqis — have a specific legal route to restoration under the 2006 law.
